Supreme Court Rules Against President Trump’s Tariffs

The majority determined that declaring an economic emergency did not include the power to impose the tariffs.

The U.S. Supreme Court issued a decision on Friday that determined President Donald Trump was not authorized to impose reciprocal tariffs under the International Emergency Economic Powers Act (IEEPA).

The court’s majority found that regulating importation, as the Congress specified in the act, does not include tariff powers for the president.

“We claim no special competence in matters of economics or foreign affairs,” Chief Justice John Roberts wrote in the opinion. “We claim only, as we must, the limited role assigned to us by Article III of the Constitution. Fulfilling that role, we hold that IEEPA does not authorize the President to impose tariffs.”

In their dissent, Justices Clarence Thomas, Samuel Alito, and Brett Kavanaugh stated, “Tariffs are a traditional and common tool to regulate importation.”

Treasury Secretary Scott Bessent had stated prior to the decision that the president’s administration is prepared to legally support many of the tariffs under other statutes.
